Short Sales: 4 Proven Ways To Speed Up The Process

One of the biggest complaints people have about short sales is how long they take to complete. Here are 4 specific tips proven to speed up the short sale process:
• Tip #1: Continue to pay all property-related expenses that are not wrapped into your regular mortgage payment–expenses like HOA fees or condo fees as well as water, sewer or other utility bills (basically any expense that is not included in your regular mortgage payment). In most cases, you have to be behind on your mortgage payments before your lender will consider discounting your mortgage loan. Unfortunately, when people stop paying their mortgage, they often stop paying these other property-related expenses—BIG MISTAKE! When you don’t pay these expenses, they will come back to haunt you by becoming liens against your property making it more difficult and time consuming to close your short sale transaction.
• Tip #2 is to terminate any rental leases you have on property that you are trying to short sell. If you can’t terminate the lease, then don’t renew it when it expires. Here’s why–in order to get a lender to approve your short sale application, you normally have to prove that you have a financial hardship. When your tenants move out, the loss of rental income will help prove your financial hardship to your lender.
• Tip #3: Make it easy for everyone who needs access to your property to get in. Realtors, appraisers, home inspectors and obviously interested buyers need to get into your property. If any of these people can’t get in or they are delayed or forced to reschedule their appointments, you are unnecessarily adding more time to the entire process.
• Tip #4: Gather and submit ALL the current documentation your lender requests from you. I know this may seem like a no-brainer, but I can tell you from many years of experience that banks generally will not even consider your short sale application if it’s incomplete in any way. For example, if your bank requires 10 things and you only provide 9, it’s as if you haven’t provided anything at all. Incomplete documentation is the most common way property owners destroy their chances of getting a bank approval.
In general, the homeowner/seller is the key to speeding up the short sale process. By removing self-imposed roadblocks, you reduce delays so that you can close faster.

HOW MUCH DOES IT COST TO SHORTSALE A HOME
In most cases, it doesn’t cost you a dime if you list your home for sale with me. I throw in negotiating with your lender to get them to agree to allow you to sell your home for less than you owe them.
THE SHORT SALE:
Lenders are fully aware of these conditions. Even though they want their loan paid in full, what they want less is for the homeowner to no longer be able to meet his mortgage payment, thus forcing the lender into the very expensive legal process known as foreclosure — legally taking the house away from the homeowner in order to try to satisfy as much of the debt as possible.
THE REASON THE SHORT SALE IS OFFERED:
So not for the purpose of wanting to be good neighbors, helping out the homeowner, lenders have developed a negotiated process called the Short Sale in order to minimize the lender’s potential loss.
HOW IT WORKS:
Here’s what happens. The homeowner notifies the lender that the loan is in trouble because he can’t continue to make the payments, that the home doesn’t appear to be worth what is owed on it, and that he needs the cooperation of the lender if the home is to sell.
The lender reviews the financial and credit history and condition of the homeowner, then has the home independently studied by a chosen professional real estate agent, broker or appraiser to assess the value. If the lender then chooses to allow a Short Sale, the homeowner is notified to what price the listing price can be reduced to.
The home is put on the market at or near that value.
THE CONSEQUENCES TO THE HOMEOWNER:
When a purchase contract is received by the homeowner, it is given to the lender for approval of the Short Sale terms. Assuming the lender agrees to let the sale take place, at closing, the lender has three options remaining: 1) he can forgive the remaining balance owed the him by the homeowner 2) he can take a deficiency judgment against the homeowner for the balance and other charges due him 3) he can offer to convert the balance owed him into a secured or unsecured loan, with monthly payments to be made by his client.
THE SFR PROFESSIONAL CERTIFICATION:
So the National Association of Realtors prepared a course of study and professional certification for those members who are willing to handle Short Sale and Pre-Foreclosure negotiations. The designation is known as SFR and it stands for Short Sales & Foreclosure Resource.
I have that SFR certification as well as a CDPE designation and knowledge of how HAFA works.
The primary key to a successful Short Sale with the least amount of consequence to the homeowner is to begin the process as soon as the homeowner realizes he is in trouble. Call a professional SFR designee immediately and get the process underway.

Short Sale Bpo Process – Insider Secrets to Getting Short Sale Accepted

This process typically happens when the property’s value had dropped below the amount due on the mortgage. This situation is generally referred to as the property being “upside down” in equity. Currently there are as many as 12,000,000 Americans who are facing the question, “Why should I make a mortgage payment when my home is worth so much less than I owe?” Short Sale Bpo Process
If a homeowner knows he will not be able to continue to make his mortgage payments he has the option of doing a short sale if his lender agrees. The lender generally will allow a short sale instead of having the expense and time involved to take the homeowner through the foreclosure process. The homeowner must sell the property because he is the owner of the property, the lender can not sell the property on its own unless they foreclose.
Short sales are often done by realtors®, real estate investors, or entities who specialize in doing short sales. The actual short sale, while being a loser for the homeowner, is a profit maker for all the parties involved in the process except the homeowner and the lender. Because of this the lender requires a “short sale package” be completed and at least one property analysis to determine the property’s market value. This analysis is usually done by a real estate agent and the report is called a Broker’s Price Opinion “(“BPO”).
If an investor is trying to buy the short sale property he needs to get the lowest possible price to make a profit, and he tries to “influence the BPO” or the person at the lender handling the case. This lender representative is called a Loss Mitigation Representative (“Loss Mit Rep”). Influencing the BPO can be done legally in a number of ways. Legally influencing the Loss Mit Rep can take more effort.
Following are a three techniques that have worked for us: Short Sale Bpo Process
1. Frequently, the Loss Mit Rep doesn’t answer your telephone messages or e-mails and your perspective short sale seems like it will never get done. It’s frustrating and very aggravating but this “make-um sweat” is part of what they are trained to do. Besides she probably has other deals she can complete where she will earn an easier and larger commission. Yes, Loss Mit’s make commissions (bonuses, etc.) based on the discounts (small is better here) they get accepted.
A very powerful technique to overcome the aggravation of not knowing where you are in the process, if you seem to be trading punches with the Loss Mit is to cancel your file. Stop the processing by sending a Cancellation of Offer Notice. The next thing to do is wait 10 days and resubmit the file from the beginning. A new Loss Mit will be assigned to your file and it is highly likely that you will have a better chance because the work has been completed on the lender’s side. This “cancel and resubmit” is standard operating procedure (“SOP’s”) for many of the larger short sale operations in the country when they know their offer is below what is the “easily acceptable” offer (78% – 82% of final judgment) for the lender.
2. If you aren’t regularly submitting “Sexual Offender” information with your short sale package you should consider it. This information is easily obtained online and is a powerful psychological motivator for the Loss Mit Rep doing the package. It may be just the one piece of info that makes the difference in your deal getting done more quickly.
3. Here is a best kept industry secret – the Loss Mit can accept 80% of the BPO without approval from a Supervisor. Most people doing short sales are striving to get the BPO to the price they are offering and often it comes in at that price. Sometimes it comes in ridiculously high. This is most often the BPO agent trying to impress the lender. Depending on the motivation of the buyer you should have already in hand, negotiate like crazy as the other option if the property goes to foreclosure, the lender will pay an additional $45,000 cost (on average) to get the property through foreclosure.
This simple ideas have made investors hundreds of thousands of extra dollars on short sale packages so the next time you decide to try a short sale integrate at least one of these into the process. Short Sale Bpo Process

Make your paperwork complete
Short sales, just like any foreclosure prevention plan, entail a fair bit of paperwork. Write a convincing hardship letter

They can also help you with legal issues such as lending fraud and credit report errors. An attorney with short sale experience will also have useful connections with the bank, which can get your application to the top of the file faster. At the very least, you’ll save hours of phone time trying to get to the bank’s short sale office.
Do your research
Approach your lender with a solid idea of how the short sale process works and what you have to offer. Start by looking up property values in your area and comparing them with your own; that way, all your lender has to do is confirm it to see that your home cannot sell for enough to cover your unpaid balance. A short sale agent can draw up a list of comparable property values for you, which you can attach to your short sale application.

What is a Short Sale and How Does the Process Work?

Word has gotten out that short sales can help borrowers avoid foreclosure. While this is true, the process is complex and requires authorization from the originating mortgage lender.
There is no simple explanation of what is a short sale. At present, no unified protocol exists, although lenders must abide by certain criteria. Not all properties or borrowers qualify for short selling their property. Nor, are all lenders required to offer this transaction.
Short sale criteria require borrowers to be a minimum of 31 days delinquent on their mortgage note. The appraised property value must be less than the balance due on the loan and borrowers cannot own assets which could be used to repay the debt.
The term ‘short sale’ means the bank allows borrowers to sell their property for less than they owe on their loan. Short sales are usually offered when all other methods to save the home from foreclosure have been exhausted. It is important to understand once a home has entered into foreclosure it is no longer eligible for short sale. Therefore, it is crucial for borrowers to contact their lender when they are unable to continue making mortgage payments.
Short sales are handled through each lender’s loss mitigation department. Once borrowers default on their loan, a loss mitigator is assigned to handle their account. This individual is responsible for assisting the borrower to resolve the delinquency. They do not approve or disapprove short sale requests. Instead they act as a mediator for the borrower and lender.
Mortgage lenders usually require borrowers to submit a short sale hardship letter describing events which caused delinquency of the loan. The letter of hardship is an important element of obtaining short sale approval and borrowers should take time to carefully craft it.
Loss mitigators prefer handwritten letters which include a detailed timeline of events, along with any action taken to overcome financial challenges. Lenders are more apt to grant approval to borrowers who lost their job or encountered medical problems than to those who engage in frivolous spending.
The short sale process takes between four and six months to complete. Borrowers will undergo a financial audit and are required to submit a myriad of documentation to the loss mitigator. Some banks require borrowers to have a buyer in place before granting short sale approval. Others will allow the borrower to list their property through a realtor.
When property is listed through a realtor, banks generally grant a grace period of a few months to locate a buyer. If the property is not sold within the specified timeframe, the lender will commence with foreclosure action.
Last, but not least, it is important to determine what type of short sale is offered through the lender. Two types of short sales exist: Deficiency Judgment and Payment in Full without Pursuit of Deficiency Judgment.
Payment in Full releases borrowers from repayment of the deficiency between the sale price and loan balance. Deficiency judgment requires borrowers to repay the deficit. This can be a substantial amount and take years to repay. Judgments remain on borrowers’ credit reports until paid in full.
